Terms & Conditions

Welcome to IMY360 Photography. By engaging our photography and videography services, upon making the booking fee, you (the "Client") agree to the following Terms and Conditions. Please read them carefully to understand your rights and responsibilities.

1. Services Provided

• IMY360 Photography will provide professional wedding photography and/or videography services as outlined in the signed contract or package chosen by the Client.

• Services include pre-wedding, wedding day, and/or post-wedding coverage as per the Client's selection.

2. Booking and Payments

• Deposit and Booking Confirmation: A non-refundable deposit of 50% is required to secure your booking date. The booking is only confirmed upon receipt of the deposit. Remaining 40% to be paid one (1) month prior to the event and the final 10% prior to the printing process.

• Payment Schedule: The remaining balance 40% is due one (1) month before the wedding date. If the balance is not paid by the due date, IMY360 Photography reserves the right to cancel services. The final 10% prior to the album printing/video editing processes.

• Additional Charges: Additional hours, specific requests, or services outside the agreed package will incur additional fees as listed in the contract.

3. Cancellation and Refunds

• Client-Initiated Cancellation: If the Client cancels the booking, the deposit is non-refundable. Additional refunds, if applicable, will depend on the timing of the cancellation: 25% refund if cancelled 8 months before the event.

• Company-Initiated Cancellation: If IMY360 Photography cancels due to unforeseen circumstances, the Client will receive a full refund of all payments made. If agreeable to both parties, IMY360 Photography may arrange a substitute photographer/videographer.

4. Event Schedule and Timeliness

• The Client is responsible for ensuring the event adheres to the agreed schedule. Delays that impact the work or coverage may result in reduced coverage or additional charges, which will be discussed in advance.

5. Permissions and Venue Restrictions

• The Client is responsible for securing access, permissions, and any necessary photography/videography permits at the wedding venue(s). Any restrictions imposed by the venue that impact coverage will not be IMY360 Photography's responsibility.

• Drone service in the packages (if applicable), is FREE of CHARGE, in the case of rain, or other restricted weather conditions, including signal interference will cause no fly condition.

6. Copyright and Usage Rights

• Company Usage: The Client grants IMY360 Photography the right to use selected images and videos for portfolio, social media, marketing, and promotional purposes unless otherwise stated in writing by the Client.

• Client Usage: The Client receives personal usage rights for their photos and videos. Commercial use or distribution to third parties without written permission from IMY360 Photography is prohibited.

7. Editing and Delivery

• Editing: IMY360 Photography will deliver professionally edited images and videos according to the package chosen. Requests for additional edits outside the standard package may incur additional fees.

• Delivery Timeline: Final images (album) and videos will be ready for self collection within 120 days after the selected pictures returned. Any delays due to unforeseen circumstances will be communicated promptly to the Client.

8. Product Loss or Damage

• IMY360 Photography is not liable for any damage or loss of final products once they have been delivered to the Client. If physical products (e.g., albums, USB drives) are provided, it is the Client's responsibility to handle them with care.

9. Limitations of Liability

• IMY360 Photography is not responsible for poor or compromised coverage due to weather, lighting issues, venue restrictions, or interruptions by guests.

• IMY360 Photography's total liability for any loss or damages related to services provided will not exceed the amount paid by the Client for the services.

10. Indemnification

• The Client agrees to indemnify and hold IMY360 Photography harmless from any claims, damages, or losses that may arise from the services provided, except in cases of gross negligence or intentional misconduct by IMY360 Photography.

11. Force Majeure

• IMY360 Photography shall not be held liable for delays or cancellations due to events outside of its control, such as natural disasters, strikes, health pandemics, or government regulations. If services cannot be provided as agreed due to such events, IMY360 Photography will work with the Client to reschedule based on the availability slots.

12. Governing Law

• These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Malaysia.

13. Amendments

• IMY360 Photography reserves the right to amend these Terms and Conditions as necessary. The Client will be notified of any changes affecting their contract.
